Terms of service

These terms cover buying from ShadowPhones, operated by Gifted Hacker, LLC, an Idaho limited liability company. Placing an order means you accept them.

What we sell

Used and refurbished Google Pixel handsets with GrapheneOS installed. Every phone is second-hand. Cosmetic condition is graded by our suppliers and we publish their grading unchanged — see how condition is graded.

Each listing is one specific handset, not a model from a shelf. The photographs are of that device. When it sells, the listing goes.

Condition, faults and expectations

• Grades (A+, A, B, C) describe appearance only.
• Where a supplier has disclosed a functional fault, we repeat that disclosure on the product page, separately from the grade. Buying a handset with a disclosed fault means accepting that fault.
• Battery health figures are as measured by the supplier and are a snapshot, not a guarantee of future capacity.
• Photographs cannot show every scratch. Use the photographs and the grade together.

Orders, pricing and payment

Prices are in US dollars. Payment is processed by Stripe; we never handle your card details.

Placing an order is an offer to buy. We accept it when we confirm your order by email. If we can't fulfil it, we'll refund you in full — see below.

We try hard to keep listings and prices accurate. If an obvious error appears (a price plainly wrong, a listing for a handset we don't have), we may cancel and refund rather than honour it, and we'll tell you why.

If we can't get your handset

Because each listing is a single physical device, one can occasionally be claimed elsewhere after you've paid. If that happens we refund you in full, promptly, and tell you what happened.

We will never substitute a different device without asking you first.

Timing

Nothing ships the day you order. There are two stages:

1. Sourcing — we order your handset and wait for it to reach us. That timing is our supplier's, so we can't promise a date.
2. Build and ship — about 5–7 business days, starting when the handset reaches us, not when you order.

These are estimates in good faith, not guarantees. We'll email you when your handset arrives with us and again when it ships. You may cancel for a full refund any time before it ships.

Delivery

Flat $10.00 shipping to any address in the United States. We don't ship internationally. Free local handoff in Sandpoint, ID if you choose it at checkout.

Risk of loss passes to you on delivery to the carrier, but if a parcel goes missing in transit, talk to us — we'll help you chase it and we won't leave you stranded.

The software

GrapheneOS is an independent open-source project. We install it; we didn't write it, and we're not affiliated with, sponsored by, or endorsed by the GrapheneOS project or Google. The operating system is provided by its authors under its own licence and without warranty from us.

We flash from the project's official release, verify it against its signing key, and re-lock the bootloader so verified boot protects the install.

The phone is yours. You're free to unlock the bootloader, install something else, or take it apart. Doing so is entirely at your own risk, is not supported by us, and may end our hardware warranty where the change caused the problem.

We can't guarantee any particular third-party app works under GrapheneOS. Some apps — certain banking apps especially — refuse to run on it. If a specific app matters to you, ask us before you buy.

Returns and warranty

If a device is faulty or not as described, tell us within 30 days of delivery and we'll make it right — repair, replacement or refund, at our option and discussed with you.

This doesn't cover accidental damage, liquid damage, or faults that were disclosed on the product page when you bought it.

Nothing here limits rights you have under consumer protection law that can't be waived by agreement.

Acceptable use

Don't use this site to break the law, defraud us, or interfere with its operation. We may refuse or cancel an order where we reasonably suspect fraud, and refund it.

Liability

We provide the site and the goods with reasonable care and skill. To the extent the law allows, our total liability for any order is limited to what you paid for it, and we aren't liable for indirect or consequential loss — including lost data.

Back up your data. Setting up a phone, restoring a backup or factory resetting can erase things. That's on you to prepare for.

Nothing here excludes liability for fraud, death or personal injury caused by negligence, or anything else that can't lawfully be excluded.

Governing law

These terms are governed by the laws of the State of Idaho, USA, and the courts there have jurisdiction — without affecting consumer rights you hold where you live.

Changes

We may update these terms; the date at the top shows when. The terms that apply to your order are the ones published when you placed it.
